2024 Cannabis Legislation Update

Perhaps you heard, there was a Cannabis Commission that met through the fall into December. It was created after HB639 (free market bill) was killed by the Senate. And after the Governor announced (the day after that great free market bill was killed) that legalization was inevitable and laid his ground work a State run monopoly cannabis industry.

The mandate of the Commission was to explore and recommend a State run franchise model for the industry. Apparently the message that the concept of New Hampshire as a direct cannabis plant touching entity was fraught with peril was finally received. But only understood enough to attempt a workaround that would accomplish the same goal under the guise of the State as a cannabis related business and Franchisor to plant touching companies.

To say the Commission ended in spectacular fashion is an understatement, ending with No Recommendation at all for legalization. Something we’ll get into later. Today we are going to focus on some of the new bills submitted for 2024. Keep in mind there are more coming, including a great bill based on the improved free market and local control model of HB639. And we suspect, a not so great bill considering the State Franchise model and all the downsides and risk that comes with it.

HB 82 | WOULD PROHIBIT AN EMPLOYER FROM REFUSING TO HIRE OR TERMINATING THE EMPLOYMENT OF A QUALIFIED PATIENT OF THE STATE’S MEDICAL CANNABIS PROGRAM “SOLELY ON THE BASIS OF A POSITIVE DRUG TEST” – REP SUZANNE VAIL (D) | READ BILL

HB 344 | WOULD ALLOW ADULTS 21 AND OLDER TO POSSESS UP TO THREE QUARTERS OF AN OUNCE OF CANNABIS, 5 GRAMS OF HASHISH AND CERTAIN INUSED PRODUCTS. ALLOWS ADULTS TO GROW UP TO SIX PLANTS FOR PERSONAL USE AND ALLOWS GIFTING. – CAROL MCGUIRE (R) | READ BILL

HB 544 | WOULD  LEGALIZE AND REGULATE THE SALE, POSESSION AND USE OF CANNABIS. PROVIDES A PATH FOR ATC’S REGISTER SPEARATE ENTITES TO ENTER THE MARKET. – DANIEL EATON (D) | READ BILL

HB 1231 | PROVIDES QUALIFIED IMMUNITY TO REGISTERED MEDICAL PATIENTS AND THEIR CAREGIVERS TO GROW UP TO THREE MATURE PLANTS, THREE IMMATURE PLANTS AND TWELVE SEEDLINGS. ALLOWS POSSESSION OF UP TO EIGHT OUNCES OF CANNABIS. – WENDY THOMAS (D) | READ BILL

HB 1240 | WOULD ADD A NUMBER OF EATING DISORDERS TO THE STATE’S LIST OF QUALIFYING CONDITIONS FOR THERAPEUTIC CANNABIS. – HEATH HOWARD (D) | READ BILL

HB 11278 | WOULD ADD ANY DEBILITATING OR TERMINAL MEDICAL CONDITION OR SYMPTOM FOR WHICH THE POTENTIAL BENEFITS OF USING THERAPEUTIC CANNABIS WOULD, IN THE PROVIDER’S CLINICAL OPINION, LIKELY OUTWEIGH THE POTENTIAL HEALTH RISKS FOR THE PATIENT TO THE STATE’S QUALIFYING CONDITIONS FOR MEDICAL CANNABIS. – WENDY THOMAS (D) | READ BILL
