The Federal Hemp Seed Ban is Coming. Here is how you can help fight back!

Back in January we posted an article outlining alerting the hemp and cannabis community that access and development of high quality genetics will be lost by November 13th, 2026 if a new law passed by Congress takes effect.

We’ve recently received an important update we need to share and ask you to take action in fighting against this new law.

On May 13th, 2026 WABI5 published a video and article with Fairfield Hemp, a hemp seed company sharing that they might have to close their doors this fall as the new law would effectively ban their product.

The article reminds us that “in 2018, the federal government approved a bill that made any part of a cannabis plant under .3% THC” is considered hemp.

Then citing that “Last November, an exclusion to that was passed as a part of an appropriations bill to help reopen the government. She says any seed that comes from a parent exceeding that number is now illegal.” 

Further pointing out that “The product that we sell, which is hemp seeds, will now be a Schedule I drug.”

Enter the American Seed Innovation and Growth Alliance (ASIGA), which recently released their Issue Brief: Section 781’s Seed Exclusion outlining how the new laws will…

  • Regulate seeds by lineage, not chemistry
  • Contains a compliance standard that cannot be met
  • Harms patients, veterans and farmers
  • Cedes the global genetics market
  • Could have real world negative economic impacts on the $49M industrial hemp industry.
