Post Primary Cannabis Quick Hits
Yesterday was primary day in New Hampshire. Unfortunately the fight for cannabis legalization took some hits. Senator Gannon won his primary over Emily Phillips and Rebecca McWilliams lost hers. These would have been two crucial candidates to send into the general election to potentially change the complexion of the NH Senate. Should Kelly Ayotte win the Governor’s race I fear we may not see legalization for a long time.
In the meantime, here are some quick hits from today’s Cannabis Business Times as a palette cleanser.
First, it appears we may have additional movement in the national conversation over rescheduling and legalization.
Trump Signals Supports for Federal Cannabis Rescheduling, Banking Reform
“Former president Donald Trump indicated Sept. 8 that he backs President Joe Biden administration’s push for the Drug Enforcement Administration (DEA) to reclassify cannabis as a Schedule III drug under the Controlled Substance Act (CSA).”
“Not only that, but Trump confirmed that he will be voting in support of Amendment 3 this November in Florida—to legalize adult-use cannabis in the Sunshine State—and that he plans to work with Congress to provide state-licensed cannabis businesses access to traditional banking services if he’s elected to a second term as president.”
Second, it appears synthetically derived products may stay on store shelves for a while longer.
4th Circuit Court Rules THC-O Meets Legal Definition of Hemp, Deviating From DEA
“The U.S. Court of Appeals for the Fourth Circuit ruled Sept. 4 that THC-O acetate, commonly referred to as just THC-O, meets the legal definition of hemp under the 2018 Farm Bill.”
“This decision refutes the Drug Enforcement Administration’s declaration in a February 2023 letter sent to international cannabis lawyer Rod Kight that THC-O is a Schedule I controlled substance.”
